By accessing or using Deep Creative Labs ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years old to use this Service. By using the Service, you represent that you meet this age requirement.

2. Description of Service
Deep Creative Labs is an AI-powered content generation platform that provides:
- Image Generation: AI-generated images using multiple models
- Video Generation: AI-generated videos (available in select plans)
- Web Application: Browser-based interface for content creation
- Public API: Programmatic access via RESTful API
- Credit System: Usage-based model for content generation
3. Account Registration
Account creation is managed through our secure authentication system. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
- Maintain one account per person or entity
4. Subscription Plans & Credits
4.1 Subscription Tiers
We offer multiple subscription plans (FREE, BASIC, PRO, MAX) with varying credit allocations and features. Current pricing and detailed plan information are available on our Pricing page.
4.2 Credit Rules
- Monthly Plan Credits: Refresh at the start of each billing cycle and do NOT roll over
- Annual Plan Credits: Granted upfront for the full year
- Extra Credits: Purchased separately and expire 3 months from purchase date
- API Credits: Pay-as-you-go balance that does not expire
4.3 Plan Changes
- Upgrades take effect immediately with prorated credit adjustment
- Downgrades take effect at the next billing cycle
- Unused monthly credits are forfeited upon downgrade or cancellation
4.4 Refund Policy
No refunds are provided for subscription fees or extra credit purchases. All sales are final. You may cancel your subscription at any time, but no prorated refunds will be issued for the current billing period.
5. Billing & Payments
Payment processing is handled by our secure payment provider. By subscribing, you agree to:
- Automatic Renewal: Subscriptions renew automatically unless cancelled
- Payment Authorization: You authorize us to charge your payment method on each billing cycle
- Failed Payments: May result in service suspension or downgrade to FREE plan
- Price Changes: We reserve the right to change pricing with 30 days' notice
- Cancellation: You may cancel anytime from your Settings page (no prorated refunds)
7. API Usage
7.1 API Access
- API keys are available for programmatic access
- Must include valid API authentication in request headers
- API keys must be kept confidential and not shared publicly
7.2 Rate Limits
- Rate limits are enforced per API key
- Concurrent job limits apply based on your subscription tier
- Exceeding limits will result in rate limit responses
7.3 API Credits
API usage is charged using the same credit system. You can purchase API credits separately with no expiration date.
8. Content Ownership & Usage Rights
8.1 Your Content
- Prompts: You retain all rights to the text prompts you submit
- Generated Content: You own the output images and videos generated by the platform
8.2 License to Us
You grant us a limited license to:
- Store your generated content on our secure cloud infrastructure
- Process your prompts through AI infrastructure providers
- Use anonymized metadata for service improvement
8.3 Commercial Use
You may use generated content for commercial purposes, subject to the terms of our AI infrastructure providers. It is your responsibility to review and comply with their terms.
9. Prohibited Uses
You agree NOT to use the Service for:
- Generating illegal, harmful, or violent content
- Creating content that violates AI provider terms
- Abuse of the service (spam, denial-of-service attacks)
- Generating inappropriate content (if restricted by models)
- Sharing API keys publicly or with unauthorized parties
- Circumventing rate limits or security measures
- Reverse engineering the platform or AI models
- Impersonating others or providing false information
- Violating intellectual property rights of third parties
Violation of these terms may result in immediate account suspension or termination.
10. Service Availability
- We strive for high availability but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We may suspend service temporarily for security or maintenance reasons
- No refunds or credits for downtime or service interruptions
11. Intellectual Property
All platform design, code, logos, trademarks, and branding are owned by Deep Creative Labs and protected by copyright and trademark laws.
12. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
- We are not liable for lost content, business losses, or consequential damages
- We are not responsible for third-party service providers
- You use the Service at your own risk
13. Account Termination
13.1 Your Right to Terminate
You may delete your account at any time from the Settings page. Upon deletion:
- Your account data will be permanently removed within 30 days
- All generated content will be deleted
- Credit balance is forfeited (non-refundable)
- Active subscriptions will be cancelled
13.2 Our Right to Terminate
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity or abuse
- Non-payment of fees
- Legal or regulatory requirements
14. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. This includes:
- Adding or removing features
- Changing pricing or subscription plans
- Updating these Terms of Service
- Modifying referral program terms
We will provide notice for material changes. Continued use of the Service after changes constitutes acceptance.
By using Deep Creative Labs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
